U.S. Army in Poland

America’s NATO Ally Poland

Poland sits at the center of NATO’s eastern flank. Since 2017, the United States has maintained a continuous rotational presence here under Operation Atlantic Resolve — with service members cycling through on 9-month deployments.

With over 10,000 American troops currently stationed across 11 garrison sites — and an additional 5,000 announced in May 2026 — Poland has become one of the most significant U.S. military theaters in Europe. The three main U.S. installations in Poland are Redzikowo, home to the Aegis Ashore missile defense system, Poznań, seat of V Corps Forward Command, and Powidz, a major air and logistics hub.

Case Studies & Success Stories

How Our Military Lawyers in Poland Have Helped

Outcome: Sex-assault allegations crushed; both senior NCOs cleared.

The Case
While deployed to Poland, a first sergeant and a sergeant first class were accused of abusive sexual contact and scrutinized in both a 15-6 and CID investigation, threatening careers, reputations, and futures built over years of hard, front-line service.

The Result
CID and the command team found no misconduct and took no adverse action; both senior NCOs walked away fully cleared, free to continue leading Soldiers without a stain on their records.

Our Strategy
LOWMH dug into the unit’s command climate, reconstructed the context of the allegations, and prepared both NCOs to give detailed, truthful in-person statements and evidence to CID, under our real-time guidance, to expose exaggerations and eliminate any plausible basis for charges.

We highlighted:
  • Full cooperation with CID, no hesitation, evasion, or refusal to answer.
  • Concrete evidence contradicting key details in the complaining account.
  • Long records of honorable leadership, mentoring, and respect for subordinates.

Jurisdiction & Legal Reality in Poland

The Legal Landscape in Poland

Many service members stationed in Poland mistakenly believe that being overseas limits their exposure to military justice. The opposite is true. Understanding how jurisdiction works — and how quickly cases move at forward-deployed installations — is the first step toward protecting your career.

UCMJ Jurisdiction Applies

U.S. forces in Poland remain fully under the Uniform Code of Military Justice. Your physical location does not limit court-martial jurisdiction — whether you are at Camp Kościuszko, Powidz, or any forward-deployed position.

SOFA & NATO Framework

Under the U.S.–Poland SOFA (2009), the EDCA, and the NATO SOFA, the United States retains primary jurisdiction over duty-related offenses and inter-service member incidents. Host-nation jurisdiction may apply to certain off-duty offenses.

OCONUS Cases Move Fast

High tempo, multinational visibility, and compressed command timelines mean cases move from report to referral far faster than CONUS cases. Early intervention by civilian defense counsel is critical.

Frequently Asked Questions

What Service Members in Poland Need to Know — Answered

Can I Be Court-Martialed While Stationed in Poland?

Yes. The Uniform Code of Military Justice applies to all U.S. service members worldwide, regardless of location. Being stationed in Poland does not reduce your exposure to court-martial — if anything, OCONUS cases often move faster due to compressed command timelines.

Does the U.S.–Poland SOFA Mean Polish Courts Handle My Case?

Generally no. Under the bilateral SOFA and NATO SOFA framework, the United States retains primary jurisdiction over duty-related offenses and crimes between service members. Poland may assert jurisdiction over certain off-duty civil offenses, but most military-justice matters remain within the U.S. system.

What's the Difference Between a Court-Martial and an Administrative Separation?

A court-martial is a criminal trial under the UCMJ that can result in confinement, a punitive discharge, and a federal conviction. An administrative separation (ADSEP) is a non-criminal proceeding that can end your career and affect your benefits, but does not result in a criminal record. Both require aggressive defense — LOWMH handles both.

I'm at Camp Kościuszko and CID Wants a Statement — What Do I Do Right Now?

Invoke your right to remain silent and your right to counsel. You are under no obligation to provide a statement. Do not sign anything. Contact LOWMH immediately — we can intervene within hours from our Poznań office to protect your rights before the investigation gains momentum.

Can I Hire a Civilian Lawyer in Addition to My Free Military Defense Counsel?

Absolutely. You have the right under the UCMJ to retain civilian counsel at your own expense, either in addition to or instead of your appointed TDS attorney. Many service members find that a dedicated civilian team with deep trial experience provides the focused advocacy their case requires.

How Does LOWMH Defend Article 120 Sexual-Assault Allegations Overseas?

We deploy the same aggressive defense strategy used CONUS: independent investigation, forensic evidence review, expert consultation, witness preparation, and targeted cross-examination. Our in-Europe presence means no delays waiting for counsel to fly in — we begin immediately.

How Fast Do Cases Move at Forward-Deployed Locations Like Powidz or Drawsko Pomorskie?

Very fast. Rotational units operate on compressed timelines, and commanders often feel pressure to resolve cases before unit redeployment. Allegations can progress from report to preferral in weeks rather than months. Early civilian defense intervention is critical.

Do You Handle GOMORs, BOIs, and Security-Clearance Revocations in Poland?

Yes. Our practice extends well beyond courts-martial. We handle GOMOR rebuttals, Board of Inquiry representation, administrative separation boards, and security clearance LOI/SOR/LOR responses for service members across Poland and Europe.

Can You Represent Me If I'm About to PCS or Redeploy Out of Poland?

Yes. Our representation is not tied to your physical location. If you PCS or redeploy while your case is pending, we continue representing you wherever you go — leveraging our offices in Poland, Germany, and across the United States.

What Does a Consultation Cost?

Your initial 15-minute consultation with a Warrior Advocate is free and confidential. We discuss your situation, explain your options, and outline how we can help — with no obligation.
